Growthkul provides performance marketing and growth-related services, including but not limited to:

• Website and landing page creation

• Funnel strategy and development

• Meta and Google advertising management

• Lead generation and conversion optimization

• Marketing strategy and consulting

The exact scope of services will be defined in a written agreement, proposal, or onboarding document shared with the client.

3. Client Responsibilities

To ensure effective service delivery, the client agrees to:

• Provide accurate and complete business information

• Share required access (ad accounts, websites, tools) on time

• Approve creatives, copies, and strategies promptly

• Ensure compliance of their offer with applicable laws and platform policies

Delays or inaccuracies from the client side may impact timelines and performance.

4. Fees & Payments

• All fees are communicated before onboarding and must be paid as agreed

• Onboarding, setup, or initiation fees are non-refundable once work begins

• Monthly retainers or service fees are billed in advance unless otherwise stated

• Late payments may result in service pause or termination

5. No Guarantee of Results

Growthkul does not guarantee specific outcomes such as revenue, leads, ROAS, or profits.

Marketing performance depends on multiple external factors including market conditions, competition, offer quality, ad spend, and platform algorithms.

We commit to best practices, strategic execution, and continuous optimization—but not guaranteed results.

6. Intellectual Property

• All strategies, frameworks, funnels, ad structures, and methodologies developed by Growthkul remain our intellectual property unless otherwise agreed in writing

• Final deliverables created specifically for the client may be used by the client for their business

• The client may not resell, redistribute, or reuse Growthkul intellectual property for third parties

7. Confidentiality

Both parties agree to maintain confidentiality of sensitive business, financial, and strategic information shared during the engagement.

This obligation survives termination of services.

8. Termination of Services

Either party may terminate services with prior written notice as per the agreed engagement terms.

Upon termination:

• No refunds will be issued for services already delivered or billing cycles started

• Access to Growthkul systems, dashboards, or assets may be revoked

9. Limitation of Liability

Growthkul shall not be liable for:

• Platform suspensions or account bans

• Loss of revenue, data, or profits

• Indirect or consequential damages

Our total liability, if any, shall not exceed the fees paid to us in the preceding billing period.

10. Third-Party Platforms

Growthkul is not responsible for changes, downtime, or policy updates of third-party platforms including Meta, Google, Shopify, or other tools.

The client is responsible for paying all third-party tool and advertising costs unless otherwise agreed.

11. Modifications to Terms

Growthkul reserves the right to update or modify these Terms & Conditions at any time without prior notice.

Continued use of the website or services constitutes acceptance of updated terms.

12. Governing Law

These Terms & Conditions shall be governed and interpreted in accordance with the laws of India.

Any disputes shall be subject to the exclusive jurisdiction of Indian courts.
